Platform User Agreement

This User Agreement supplements the TapACrew Terms of Service and governs the specific obligations of Workers and Contractors. By registering and selecting your role, you agree to the provisions that apply to your role.

Part A: All Users

A.1 Independent Contractor Relationship

  • You are NOT an employee, agent, partner, or joint venturer of TapACrew
  • You have NO authority to bind or represent TapACrew
  • TapACrew provides technology services only

A.2 Platform Communication

All offers, contracts, and agreements between Users must be made through the Platform. Circumventing the Platform's payment system is prohibited.

A.3 Truthful Information

All information you provide (profiles, job listings, applications, reviews) must be truthful, accurate, and not misleading.

A.4 Fees

A 10% platform fee is deducted from each transaction.

A.5 Dispute Resolution

Disputes between Users are resolved between the Users involved. TapACrew may provide informal mediation but is not bound to resolve Users' disputes.

Part B: Worker-Specific Provisions

B.1 Worker as Independent Contractor

You are an independent contractor providing services to the Contractor who hires you. You are NOT an employee of TapACrew OR of the Contractor.

B.2 Self-Employment & Taxes

You are solely responsible for:

  • Federal, state, and local income taxes
  • Self-employment tax (Social Security and Medicare)
  • Estimated tax payments
  • State sales taxes where applicable
  • Business license fees and registration

B.3 Licensing & Insurance

You represent that you hold (or will obtain):

  • Trade-specific licenses required by state and locality
  • General liability insurance (especially for trades with injury risk)
  • Workers' compensation insurance where required
  • Business registration in your state

B.4 Work Performance

  • Perform work competently, safely, and in accordance with the agreed scope
  • Bring your own tools and equipment unless otherwise agreed
  • Follow site safety rules
  • Log hours accurately and honestly

B.5 Payment Acknowledgments

When confirming job completion, you must digitally sign:

  • Confirmation that work is complete
  • Lien Waiver acknowledging payment in full and waiving any right to file a mechanic's lien

Part C: Contractor-Specific Provisions

C.1 Contractor Obligations

You are solely responsible for:

  • Determining Worker classification (1099 vs W-2)
  • Compliance with federal labor laws (FLSA, OSHA, etc.)
  • Compliance with state labor laws, minimum wage, and overtime
  • Issuing 1099 forms to Workers paid $600+ per year
  • Ensuring site safety and providing necessary safety equipment
  • Verifying Worker eligibility to work in the U.S.
  • Any required workers' compensation coverage

C.2 Payment Commitment

When sending an offer, you digitally sign a Payment Commitment:

  • You commit to pay the agreed amount upon satisfactory completion
  • You have funds available to fulfill the commitment
  • Failure to pay may result in account suspension, legal action, and liens against your property

C.3 Hours Approval

You are responsible for reviewing and approving Worker-logged hours. Approved hours are the basis for final payment.

C.4 Non-Discrimination

You will not discriminate based on race, color, religion, sex, national origin, disability, age, sexual orientation, gender identity, or any other protected characteristic.

C.5 Non-Circumvention

You will not:

  • Hire Workers met through the Platform outside the Platform to avoid fees
  • Pay Workers directly via cash during active Platform engagements

Part D: Mutual Releases & Indemnification

D.1 Release of Claims Against Platform

You release TapACrew from any and all claims arising from:

  • Your use of the Platform
  • Any act, omission, or conduct of another User
  • Any job, work performed, or transaction facilitated by the Platform
  • Any injury, property damage, financial loss, or dispute with another User

D.2 Indemnification of TapACrew

You will indemnify TapACrew from any claim arising from:

  • Your breach of this Agreement or the Terms of Service
  • Your negligent, intentional, or unlawful acts or omissions
  • Your failure to pay taxes, comply with licensing laws, or carry required insurance

TapACrew is a technology platform, not an employer, staffing agency, or guarantor. You transact directly with other Users at your own risk. TapACrew is NOT financially responsible for any payment, performance, injury, or dispute between you and another User.
